The Ninth Circuit Court of Appeals has opted not to rehear the ruling that Proposition 8 – California’s ban on same sex marriage – is unconstitutional.
This means the case will next go to an 11-judge panel, and final ruling on Prop 8 will be delayed for up to another year.
The June 5 ruling to not take another look at the case was made by a 3-judge panel.
