Transgender former inmate sues Orange County

A transgender woman who was an inmate in the Orange County jail is suing the county, 14 jail employees and another inmate because she says she was raped while in jail.

Court papers just indentify the inmate as D.B., and she’s claiming a violation of civil rights.

According to the Orlando Sentinel, D.B. says she was removed from protective custody, although she was asked not to be, and placed among the general jail population. She claims her cellmate, Josh Bailey, raped her on Dec. 8, 2008.

Bailey, 23, is serving 25 years in prison for sexual battery and is named in D.B.’s lawsuit, along with corrections officer John “J.D.” Davis and 13 other employees all named in court papers as “John Doe.”

D.B. says the county does not have a policy regarding transgender inmates, whom she says are at greater risk of assault, according to the Sentinel.

The lawsuit has been transferred to federal court.
