It looks like the Supreme Court will consider the Prop 8 case, but not for a ruling just yet.
The Supreme Court docket page shows Hollingsworth v. Perry has a new notice stating the case has been “distributed for Conference of September 24.”
That’s when the justices meet privately, look at petitions and decide which cases they will accept for review. Four votes would grant the review, and usually the conference outcome is announced the Monday following but in the case of Prop 8, the justices could announce as early as the next day, according to Prop8TrialTracker.com.
What if the Supreme Court denies the petition? Then the Ninth Circuit Court of Appeals' decision stands, and Proposition 8 will be invalidated. However, Prop8TrialTracker.com reports that they case will NOT set a nationwide precedent. If they decide to review the case, they'll reach a final decision at the end of June 2013.
Another outcome is that the Court could relist the case for a later conference, simply postponing the potential Sept. 24 decision to a future conference.
